General terms and conditions of sale

THESE GENERAL CONDITIONS OF SALE APPLY TO ALL RESERVATIONS WITH THE BASTIDE DU LAIZON.

1. Preamble

1. The present general conditions have for object to define the terms and conditions in which La Bastide du Laizon allows its customers (hereafter ” the Customer(s) “), to benefit from the whole of the available services, in particular of reservation of the suites on site La Bastide du Laizon.

This website allows the reservation of suites in the Bastide du Laizon, but also dinners at the ML table.

• Through the store and the online booking area.

2. The Customer declares to have obtained from the Bastide du Laizon, all the necessary information to make his choice and to continue his reservation.

3. Any reservation made through the website www.labastidedulaizon.com implies the consultation and complete and unreserved acceptance of these general conditions as well as the conditions of sale of the reserved fare mentioned expressly in the description of the fare selected at the time of reservation.

The Customer must confirm by checking the box that he/she has read and accepted the present general conditions and the sales conditions of the reserved fare before definitively validating his/her reservation; no reservation is possible without this agreement.

For all other reservation methods, the Client receives the general sales conditions with the confirmation of his reservation. Confirmation of a reservation implies adherence to these terms and conditions of sale and full and unreserved acceptance of their provisions.

4. The Customer has the option to save and edit these terms and conditions using the standard features of his browser or computer.

5. The Site contains the following information:

• the legal mentions allowing the precise identification of the bastide of Laizon indicating its corporate name, its registered office,
• the address of electronic mail and the telephone coordinates allowing to get in touch with the Bastide du Laizon,
• the essential characteristics of the lodgings proposed by the Bastide du Laizon,
• the essential characteristics of the additional and optional services proposed,
• prices including all taxes,
• the conditions of sale of the reserved rate,
• the terms of payment,
• the general conditions of sale,

6. The Client, prior to the reservation, declares that this reservation is made for his personal needs. The Customer, by virtue of his status as a consumer, has specific rights, which would be called into question in the event that the Services reserved were not for personal use.

7. All the information provided on the Site www.labastidedulaizon.com is presented in French.

8. The Customer declares that he/she has full legal capacity to enter into the present terms and conditions.

2. Definitions

For the purposes hereof, the terms below shall have the following meanings:

• “Reservation Summary”: a dematerialized document that summarizes the characteristics of the services selected by the Customer on the www.labastidedulaizon.com website. This document precedes the Customer’s acceptance of these General Terms and Conditions of Sale and the Customer’s entry of his banking information in the context of a prepayment or a guarantee.
• “Reservation Confirmation”: a dematerialized document sent to the Client to notify him/her that his/her reservation has been taken into account, which summarizes the characteristics of the Services reserved by the Client on the www.labastidedulaizon.com website.
• “Client”: a natural person acting exclusively for his or her own personal needs.
• “Reserved Rate Terms of Sale” means the price applied on the date selected by Customer for a room category with breakfast, together with its payment terms, its terms for changing reservation dates or reserved Services and its cancellation terms.
• “Reservation request”: request for reservation of rooms, products and services in the Bastide du Laizon, made by the Customer.
• “Partners”: means any Service provider who has entered into a Service contract or partnership agreement with Bastide du Laizon.
• “Service ” : reservation of rooms, products and services in the Bastide du Laizon made by the Customer.
• “Site” means the www.labastidedulaizon.com website.

3. Object

1. These general terms and conditions define the rights and obligations of the Customer and the company operating a Barrière Hotel for all types of reservations (including remote reservations) of Services offered by Barrière Hotels.

2. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties.

3. The Customer acknowledges that he/she has read and accepted the present general terms and conditions of sale and the Terms and Conditions of Sale of the reserved tariff.

4. Modifications

La Bastide du Laizon reserves the right to modify or supplement at any time all or parts of the present general conditions of sale. In this case, the new version of the general conditions will be available on the Site with its effective date. The Customer is advised to regularly consult the general terms and conditions of sale in order to be aware of any possible modifications. In any case, the Customer will only be bound by the version of the general conditions in force at the time the Customer makes the reservation for the Service.

La Bastide du Laizon is not responsible for the damage of any nature which can result from these changes and/or a temporary unavailability or even the definitive closing of whole or part of the Site or the Services which are associated with it, such as the space of reservation on line, the private space, the unavailability of the central reservation.

5. Reservation

1. The Customer chooses Services among those proposed by the Bastide du Laizon according to his needs.

2. The Customer acknowledges that he/she has taken cognizance of the nature, price, destination and reservation terms of the available Services and has requested and obtained the necessary and/or additional information, in particular the Terms and Conditions of Sale of the reserved fare, in order to make his/her reservation in full knowledge of the facts.

3. The Client may reserve, on an individual basis, a suite within the Bastide du Laizon. For any reservation of more than one suite, the customer will renew the operation for the additional suite(s). For a complete privatization of the Bastide, the Customer can call directly by the team of the Bastide or use the online form provided for this purpose.

4. The Customer is only responsible for his choice of the Services and their adequacy with his needs, so that the responsibility of the Bastide du Laizon cannot be sought in this respect.

5. The reservation is deemed accepted by the Client at the end of the reservation process.

6. All reservations are nominative and can in no case be transferred to a third party, whether free of charge or for a fee. All reservations made for others must be made in the name of the third party who holds the reservation.

6. Reservation process

1. The reservation carried out by the Customer is done directly on line on the Site or the Bastide du Laizon to +33 (0)2 30 32 45 40.

2. The request for reservation is confirmed as of the reception by the Customer of the Confirmation of reservation, sent by the Bastide du Laizon.

3. The Client undertakes, prior to any reservation, to complete the mandatory information requested when creating the reservation file.

4. The Customer certifies the truthfulness and accuracy of the information provided.

5. The reservation process includes the following steps:

• Step 1 – Choosing the suite,
• Step 2 – Selection, if applicable, of one or more proposed complementary services,
• Step 3 – Presentation of the summary of the reservation, its total price, the terms of sale of the reserved rate, which includes in particular the terms of payment and the terms of cancellation, modifications if necessary of the choices of services (date, room, rate, additional service), and information concerning the tourist tax,
• Step 4 – Customer contact information,
• Step 5 – Terms and Conditions of Sale :

On the Site, the Customer confirms, by checking the box, that he/she has read and accepted the present General Terms and Conditions and the Sales Terms and Conditions of the reserved fare before definitively validating his/her reservation; no reservation is possible without this agreement.

• Step 6 – Online payment of booked services,
• Step 7 – Confirmation and Validation of the reservation and payment by the Customer. The seizure of banking information translates the acceptance of the Customer and has for effect to engage it contractually with regard to the Bastide du Laizon.
• Step 8 – Receipt by the Customer of the confirmation email of his reservation. This email summarizes the date of the reservation, the Services reserved, the prices including VAT with details of applicable taxes, the Terms and Conditions of sale of the reserved fare (including cancellation conditions), accepted by the Customer, the general terms and conditions of sale.

7. Cancellation or modification by the Customer

1. The Customer is reminded, in accordance with Article L. 221-28-12 of the Consumer Code, that he/she does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code.

2. The Terms and Conditions of Sale for the fare booked and accepted by the Customer specify the terms and conditions for cancellation and/or modification of the reservation. Reservations with pre-payment for a non-refundable and non-cancellable fare cannot be modified and/or cancelled.

3. The interruption of a stay, in the case of a reservation with prepayment, for a non-refundable and non-cancellable rate, does not give rise to any reimbursement.

4. When permitted by the Terms and Conditions of Sale of the reserved rate:

• the cancellation of a reservation carried out since the Site, will be carried out directly with the Bastide du Laizon.
• the modification of the reservation will be carried out directly with the Bastide du Laizon, whose telephone coordinates are specified on the e-mail of confirmation received by the Customer.

8. Cancellation by the Bastide

In case of exceptional event or impossibility to put the reserved room at the disposal of the Customer or in case of force majeure, the Bastide du Laizon will be able to propose to the Customer to cancel or to postpone without expenses his reservation. The refund will be made immediately.

9. Stay at the Bastide du Laizon

1. All guests staying at La Bastide must present a valid form of identification at check-in. In defect, the Bastide du Laizon can refuse to give him access to his room and/or cancel the reservation which he had carried out without possibility, if necessary, of refunding, in accordance with the Conditions of sale of the reserved tariff.

The customer can introduce in the room of the third persons only after having requested the express authorization of the Bastide du Laizon which reserves the right to carry out all the necessary checks.

2. The Client accepts and agrees to use the room and the common areas at his disposal in a reasonable manner. Any behavior contrary to the principles of safety and/or hygiene, the good morals and/or the public order can lead the Bastide du Laizon to ask the Customer to leave the establishment, without refunding.

3. Any damage caused by the customer or by the occupants of his fact in the room or in the various spaces occupied by him during his stay, must be reported to the reception of the Bastide and may be directly charged to him up to the amount of the costs of repair.

For security reasons and for the respect of everyone, it is formally forbidden to smoke in the Bastide. In accordance with the Code of Public Health in its provisions setting the conditions of application of the prohibition of smoking in places assigned to collective use, smoking in the Bastide exposes the customer to the fine provided for the contraventions of the third class or to legal proceedings.

4. The Bastide du Laizon has its own
Rules of procedure
intended for the Customer. The Customer accepts and agrees to abide by the said rules and regulations, the provisions of which apply both to him and to any occupant of his property. In the event of violation of the provisions of the aforementioned regulation, the Bastide du Laizon will be able to expel immediately the customer and all the people who share his stay, without any compensation and/or without any refund if a payment was already carried out.

10. Guarantees

The Bastide du Laizon is held of the guarantee of conformity of the Services, under the conditions posed in articles L. 212-1 and s. of the Consumer Code.

11. Responsibility

1. The photographs presented on the Site are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the Bastide du Laizon, give as accurate an idea as possible of the accommodation services offered, particularly in view of possible changes in furniture or renovations. The Customer shall not be entitled to any claim as a result.

2. In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements composing the offers of the Bastide du Laizon present on the Site are strictly prohibited, as well as any reproduction of the decorations and/or characteristic elements of the Bastide.

3. The Bastide du Laizon will not incur any responsibility for all the direct or indirect damage resulting from the fact of a third, the Customer or the partners of the Bastide du Laizon.

4. Hypertext links can return towards other sites than the Site of La Bastide du Laizon, which releases any responsibility as for the contents of these sites and the proposed Services. The Bastide du Laizon set up measures of protection and safety of its information system against the acts of malevolence, however, the connection to the Site and the realization of a reservation imply for the Customer, the knowledge and the acceptance of the characteristics and the limits of Internet, the absence of protection of certain data against possible hijackings or piracy or risks of contamination by possible virus circulating on the network. La Bastide du Laizon declines any responsibility in case of misuse or incident related to the use of the computer or any support allowing the access to Internet, of the maintenance or the dysfunction of the Web site or any other technical connection and of the sending of information to an erroneous address.

5. Any reservation or payment that would be irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the expense of the Customer, without prejudice to any civil or criminal action against the latter.

6. The Bastide du Laizon reserves the possibility of not receiving or of expelling, without refund, the customers whose dress is indecent and neglected, whose dress is intended to dissimulate the face (Law N°2010-1192 of October 11th, 2010), the customers having a noisy, incorrect or alcoholic behavior, the customers whose behavior is contrary to hygiene, to the good morals and to the public order. Proper attire is required at the ML table and in the common areas of the Bastide.

The Customer is courteous and respectful towards the staff of the Bastide. On pain of exclusion without reimbursement, the Customer shall refrain from any verbal or physical violence, any racist behavior or remarks as well as any form of harassment.

12. Awards

1. The prices for the reservation of the Services are communicated before and at the time of the reservation.

2. The prices quoted are per room for the number of persons and the date(s) selected. Unless otherwise stated, Additional Services (excluding breakfast which is included in the suite rate) are not included in the rate. Upon confirmation of the Customer’s reservation, the total amount of the reservation for Services will be indicated.

The prices take into account the VAT applicable on the day of the reservation and any change in the applicable VAT rate will be automatically reflected in the prices indicated on the date of invoicing.

3. The prices are confirmed to the Customer all taxes included (TTC), in €uro. The prices communicated are only valid for a certain period of time. All reservations are payable in € (euro).

4. The tourist tax, and any other tax specific to the communes indicated for each tariff, are to be paid directly on the spot at the Bastide du Laizon except in the case of an on-line payment where this amount is included.

13. Payment

1. The Client communicates his payment data to pay for the reservation before the stay. The information required is: the credit card number, without spaces between the digits, the date of validity (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram in the case of a prepayment.

The Bastide du Laizon chose STRIPE and/or PAYPAL to secure the payments on line by bank card by means of the 3D Secure. The Customer’s payment card is subject to security checks (credit check, card country check, IP address country check) by the designated partner and may be refused for several reasons: stolen or blocked card, ceiling reached, input error, etc. In the event of a problem, the Customer must contact his bank on the one hand, and the Establishment or any other entity on the other hand, to confirm his reservation of the Service and his method of payment.

The available and communicated online payment methods can be Visa and Mastercard, American Express, etc. This list is subject to change.

2. The payment is debited at the time of booking and payment on the website.

3. At the time of payment, the amount that is debited at the time of booking includes: the price of the accommodation, the taxes related to the accommodation, the price of breakfast, the taxes related to the catering and any other additional services selected by the Client.

14. Personal data

1. Your personal data requested in the context of your reservation, i.e. your title, surname, first name, postal address, telephone number with country code, e-mail address, payment card details (number, type of card, name of the holder, expiry date and cryptogram in the event that it is transmitted to us) as well as any data communicated or generated by your navigation constitute confidential data.

2. They are accessible only to the Bastide du Laizon and have for finality the treatment of your reservations and stays and; provided that you accepted by notching the corresponding box, to transmit you our newsletter, or to answer your requests or to communicate commercial offers. They are preserved for the duration necessary to the commercial relation established between the Customer and the Bastide du Laizon.

3. Some of the information requested in the forms is mandatory and is indicated by an asterisk. If you choose not to provide this information, we will not be able to process your request.

4. In accordance with the modified law “Informatique et Libertés” of January 6, 1978, you have the right to access, rectify, delete, and request a limitation of the processing of your personal data.

You also have the right to object to the processing of your data on legitimate grounds and the right to object to the processing of your data for marketing purposes as well as the right to give us instructions on what to do with your data after your death.

15. Force majeure

The Bastide du Laizon could not be held responsible towards the Customer in the event of non-fulfillment of its obligations resulting from an event of absolute necessity.

In the same way the Customer could not be held responsible towards the Bastide du Laizon, in the event of non-fulfillment of its obligations resulting from an event of absolute necessity.

Are considered as force majeure or fortuitous event those usually recognized by the jurisprudence of the French Courts and Tribunals.

The Bastide du Laizon will be able to propose to the Customer to cancel his reservation which gives place to an immediate refunding or to postpone his reservation to a later date.

16. Applicable law

1. The present General Terms and Conditions of Sale are governed by French law.

2. This is true for both substantive and formal rules.
